ORDER
(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) This Habeas Corpus Petition is filed for a direction to the respondents 1 and 2 to secure and produce the body or person of the detenu namely Ponnalagu, W/o.Rajamuniyandi, aged about 25 years and produce her before this Court and set her at liberty.
2.The case of the petitioner is that he got married to the missing person viz., Ponnalagu and they were blessed with two children. The missing person had quarrelled with her husband and left her house in the 2nd week of March 2024 and stayed at Mayathevanpatti, in her sister's house. On 03.12.2024 at about 09.30 a.m., she had left the house alone leaving her children at Mayathevanpatti and she had not returned back. Thereafter, the petitioner had given a complaint before the second respondent police and a case has been registered in Crime No.276 of 2024 2/5
under Woman Missing. Since no action had been taken by the respondent police, the present Habeas Corpus Petition is filed.
3.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents. 4.When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondents submitted that based on the complaint that Ponnalagu, aged about 25 years was found missing, a case in Crime No.276 of 2024 was registered under "Woman missing" on 03.2.2024. During the course of investigation, it came to light that the missing person had gone along with one Chelladurai leaving her children in her relative's house. He further submitted that it is a case of elopement and the respondents are taking steps to find out the whereabouts of the missing person. 5.Taking into consideration the aforesaid submission and also finding that missing person is not under illegal detention of anybody, the Habeas Corpus Petition stands closed with a direction the respondent police to continue with the 3/5
