ORDER

This Writ Petition has been field for issuance of the Writ of Madamus, to direct the respondent not to publish the magazine in the name of Asiriyar Koottani till the new General Secretary of the Association is elected within the a time frame.

2. The learned counsel for the petitioner has relied on the proceedings dated 11.06.2024 of the Judge Commissioner where it is stated as under:

"When it has been pointed out that Mr.N.Rengarajan has retired from serice and he can no more be a General Secretary of the Federation, it has been fairly considered by the counsel appeared for him that the By-laws says so and he cannot continue as a General Secretary of the Federation."

3. When the said Rengarajan is no more a General Secretary in the Association, he cannot publish any magazine in the name of Rengarajan as a General Secretary or in an independent capacity also he cannot publish the magazine since he retired from service.

4. Therefore, the respondent is directed to consider the petitioner's representation dated 01.07.2025 in the light of the above observation and in the light of the proceedings dated 11.06.2024 passed by the Judge Commissioner. The said exercise shall be completed within a period of two weeks from the date of receipt of a copy of this order. No Costs. Consequently, connected miscellaneous petition is closed.
