ORDER : The Court made the following order :- The petitioner/ Accused who was arrested and remanded to judicial custody on 08.04.2022 for the offences under Sections 450, 506(i) of IPC and Sections 5(1),5(j)(ii) and 6 of Protection of Children from Sexual Offences Act, 2012 and Section 3(2)(va) of SC/ST (POA)Act 2015 in Crime No.13 of 2022, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner herein administered some medicine on the victim thereafter she got fainted and the petitioner had committed aggravated penetrative sexual assault on the victim. Hence the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case.

4. Learned Additional Public Prosecutor would submit that this is the second application seeking bail filed by the petitioner before this Court. Without cross examining the witnesses before the trial Court, the petitioner has filed this petition seeking bail.

5. Considering the conduct of the petitioner, this Court is not inclined to grant relief to the petitioner. If the petitioner is released on bail, he will abscond or tamper the witnesses. The petitioner can revive the petition after cross examination of material witnesses are over.
