ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Writ of Mandamus has been instituted to direct the respondents to cancel the patta bearing No.3175 issued in the name of the 5th respondent and his father, namely, Ramaiyan Nadar for Survey No.2982 to an extent of 56 cents of Nattalam Revenue Village, Vilavancode Taluk, Kanyakumari District and to ensure the smooth worship by the public by the devotees. 2.Application seeking patta or cancellation of the same is to be considered only by the competent authority and the appellate authority as contemplated under the Patta Passbook Act, 1983. If at all any patta has been granted illegally or fraudulently or by way of coercion, an aggrieved person has to approach the competent appellate authority under the Patta Passbook Act for 2/5

conducting an enquiry and redress the grievance. High Court in exercise of power of judicial review cannot adjudicate the disputed issues, which is to be done by scrutinizing the documents and evidence available on record. 3.That being the procedures contemplated under the Act, the petitioner is at liberty to approach the competent appellate authority to redress his grievance in the manner as contemplated under the statutes and rules framed thereunder. 4.With the above observation, this Writ Petition stands disposed of. No costs.
