ORDER
This writ petition is filed seeking a direction to the respondent to subdivide and issue patta in the name of petitioner's father-in-law, Muniyandi, in respect of the property situated in Survey No.49, Kalaiyanoor Village, Ramanathapuram District, as per the order of the first respondent dated 31.10.1989.
2.Heard the arguments of Mr.S.Selva Aditiya, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Government Advocate appearing for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself. 3.According to the petitioner, the subject property was originally assigned in favour one Vaitheeswaran in the year 1969. He executed a registered sale deed dated 15.07.1977 in favour of one Muthu, conveying 2 acres of land in the subject property. On the very same day, he
executed another sale deed, conveying 2.30 acres of land in the subject property in favour of Meiyappan. Subsequently, Meiyappan executed registered sale deed dated 09.07.1985 in favour of petitioner's father-inlaw, Muniyandi in respect of 2 acres of land. The remaining 30 cents of land purchased by Meiyappan was acquired for the formation of road. After death of Muniyandi and the petitioner's husband, Arjunan, the petitioner has been in possession and enjoyment of the subject property. During the UDR updation, the property in the name of petitioner's father-in-law, Muniyandi was erroneously classified as 'Tharisu' in the revenue records. In view of such entry, the said property was wrongly assigned in favour one Saroja and Chellammal. Therefore, the said Muniyandi submitted a representation before first Respondent on 26.05.
1989, seeking cancellation of the said assignment and the same was ordered in favour of Muniyandi and the said the order was confirmed by the Commissioner of Land Administration. The order passed by Commissioner was challenged by one Chellammal and Saroja, who were given second assignment, by way of writ petition in W.P.No.
Commissioner of Land Administration for fresh consideration, after affording opportunity to the said Chellammal and Saroja. Again, the order passed by first respondent was affirmed by Commissioner of Land Administration in his proceedings in g.K.[p.2/29008/94> dated 22.06.2001. Even after lapse of nearly 24 years, the revenue records have not been mutated as per the order passed by the first respondent. Hence, the petitioner has come before this Court. 4.The learned Additional Government Pleader appearing for the respondents would submit that based on the representation submitted by the petitioner dated 22.08.2024 seeking mutation of revenue records, the first respondent called for a report from second respondent in his proceedings in m6/7679/2024 dated 31.08.2024. 5.Since the request made by the petitioner seeking mutation of revenue records is pending before the first respondent, this Court, without expressing any opinion on the merits of the matter, is inclined to direct the first respondent to conclude the proceeding initiated by him in
his proceedings in m6/7679/2024> dated 31.08.2024 and pass final orders within a period of twelve weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner and above mentioned Chellammal and Sarajo / the legal representatives of the said persons.
