ORDER

The petitioner herein seeks a direction to the the first respondent to dispose of the appeal filed by the petitioner, dated 16.08.2024, seeking cancellation of patta issued in the name of the respondents 3 and 4 in respect of the properties situated in Survey Nos.70/1A, 70/1C, 70/C, 70/3, 70/7, 70/8, 70/9 and 70/10, Perumparai, Manalur Village, Authoor Taluk, Dindigul District, within the time stipulated by this Court. 2.Heard the arguments of Mr.J.Lawrance, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents 1 and 2. By consent

of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

3.According to the petitioner, the patta for the above mentioned properties was wrongly issued in favour of the legal heirs of one Samikannu and Arockiam, over looking the possession of the petitioner and others over the subject property. Therefore, the petitioner and others filed an appeal before the first respondent on 16.08.2024, seeking cancellation of patta issued in the name of the legal heirs of above mentioned persons. The same has not been considered. Hence, the petitioner has come before this Court.

4.The learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the appeal filed by the petitioner will be considered in accordance with law.

5.The petitioner herein has impleaded only few legal heirs of the above mentioned Samikannu and Arockiam as respondents 3 and 4. The others have not been impleaded. In view of the same, without

expressing any opinion on the merits of the matter, the first respondent is directed to consider the appeal filed by the petitioner dated 16.08.2024 and pass final orders on its own merits, within a period of twelve weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner, the private respondents 3 and 4, the legal heirs of the abovementioned Samikannu and Arockiam and other interested parties. Accordingly, this Writ Petition is disposed of. No costs.
