Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a writ of mandamus directing the respondent No.3 herein to issue and release the sale deeds of the houses of the petitioners herein which were allotted in the V.M.Chatram Scheme in writ petitions in WP(MD)Nos.5980 to 6003 of 2011, 6080 to 6113, 6630 to 6644, 6479 to 6504, 7430 to 7446 of 2011, 7447 to 7450 of 2011, 8602 to 8620 of 2011.

ORDER

The petitioners are the allottees of the Housing Board and they have filed this writ petition with a grievance that the respondent Housing Board has not executed the sale deed in their favour.

2.When this writ petition has been taken up for hearing, the learned Standing Counsel appearing for the respondent Housing Board submits that except one Navaneetha Krishnan and P.Gopalakrishnan, sale deeds have been executed to all others in total 102 persons. However, in respect of Navaneetha Krishnan, he has not paid the cost and P.Gopalakrishnan, NOC is pending from the District Collectorate.

3.In view of the above submission, the said Navaneetha Krishnan shall pay the cost within a period of eight weeks from the date of receipt of a copy of this order and on receipt of the cost from him, the respondent Housing Board shall execute sale deed within a period of twelve weeks therefrom and as when the said Gopalakrishnan produces NOC, the respondent Housing Board shall execute the sale deed in his favour.

4.With the above directions, this writ petition is disposed of. No costs. 06.11.2023 dsk 8/10
