ORDER

This writ petition has been filed for a writ of Mandamus to direct the first respondent to execute the sale deed in respect of Plot No.MIG 279, Navalpattu NHS Phase-1, Thiruverumbur Taluk, Tiruchirappalli District, in favour of the petitioner.

2. The learned Standing Counsel for the first respondent submits that the first respondent has called for information from the second respondent as to whether the petitioner's deceased father, Late.Shanmugarajan, had paid initial amount of Rs.19,000/- in the year 1986.

3. The learned counsel for the petitioner submits that the amount would have been collected directly by the first respondent from the second respondent, as the entire project was conceived by the second respondent and the first respondent was merely a nodal agency for identifying the land and 2/5

for construction of the house. It is unlikely that the amount may not have been collected if the subsequent amount has been paid for.

4. It is informed that the Manager (Marketing and Sales), Tamil Nadu Housing Board, K.K.Nagar, Tiruchirappalli is the competent authority. Therefore, the Manager (Marketing and Sales), Tamil Nadu Housing Board, K.K.Nagar, Tiruchirappalli is suo motu impleaded as third respondent. Registry is directed to carry out necessary amendments in the cause title.

5. Under these circumstances, there shall be a direction to the third respondent to expedite the clarification required from the second respondent within a period of 6 weeks from the date of receipt of a copy of this order.

6. It is made clear that even in case the aforesaid amount has not been paid, the sale deed shall be executed in favour of the petitioner and other legal heirs of Late.Shanmugarajan and the sale deed shall be released after ascertaining the amount has been paid or not. 3/5

7. The writ petition stands disposed of. There shall be no order as to costs.
