Prayer in CRL A (MD)No.41 of 2024 This Criminal Appeal is filed under section 14(A)(2) of the Schedule Castes and Tribes Prevention of Atrocities Act, 2015 (Amended by Act 1 of 2016), to call for the records relating to the order dated 09.11.2023 passed in Crl.M.P.No.1113 of 2023 in S.C.No.35 of 2022 on the file of the Special Court for trial of Cases under SC/ST (POA) ACT, Thoothukudi, and set aside the same as arbitrary and consequently to release the appellant on bail in connection with case in Crime No.420 of 2022 on the file of the second respondent police .
ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.S.Vishnuvardhan, Advocate for the Petitioner and of Mr.M.Sakthi Kumar, Government Advocate (Crl.side )for the 1st and 2nd Respondents, the Court made the following order:
"This petition has been filed to relax the condition imposed on the petitioner in Crl.A.(MD).No.41 of 2024 on 21.03.2024.
2.The learned counsel for the petitioner submitted that the petitioner has been complying with the condition regularly and he prayed for relaxation of the said condition.
3.The learned Government Advocate (Crl. side) submitted that the petitioner has been complying with the condition regularly. Investigation in this case has been completed and charge sheet was also filed before the concerned Court. 4.Taking into consideration of the submissions made by both the counsels, the condition imposed by this court in Crl.A.(MD).No.41 of 2024 on 21.03.2024 is relaxed and the petitioner shall appear before the concerned Court on receipt of summons."
