ORDER : The Court made the following order :- The petitioner / Accused herein, who was arrested on 07.06.2023 for the alleged offence under Sections 366 and 376(i) of IPC in Crime No.257 of 2008, on the file of the respondent police, seeks bail.

2. Noting that warrant was issued against the petitioner due to his absence before the trial Court. Because of his absence, trial could not be completed. A direction was issued to the petitioner to cross examine the witnesses but the petitioner has failed to do so. Seeking bail, this petition came to be filed.

3. After cross examination of the witnesses are over, the petitioner can move the concerned Court for bail. Without complying the condition, the petitioner has again approached this Court by way of filing a petition for bail.

4. Learned Additional Public Prosecutor submitted that the case is posted before the trial Court, for cross examination of investigation officer. 2/3
