PRAYER :- For Bail in Crime No.245 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/Accused No.1 herein, who was arrested on 04.07.2023 for the alleged offence under Sections 341, 294(b), 323, 324, 397 and 506 (ii) of IPC, in Crime 1/4

No.245 of 2023, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the defacto complainant is working in a finance company. On the date of occurrence while he was returning to his office after collecting money from their customers, four unknown persons way laid, questioned him and abused them in filthy language. When the defacto complainant asked them that why they were asking such questions, they attacked him and took away his phone and Rs.4,000/- by showing knife. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and did not involve in any offence as alleged by the prosecution . 4.The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is having three previous cases, among which, one case is disposed of.

5. According to the learned counsel for the petitioner, another two cases are also disposed of. But other particulars are not available. 2/4

6.Considering the facts and circumstances of this case and also considering the period of incarceration, this Court is inclined to grant bail to the petitioner with certain conditions.

7.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Theni, and further condition that the petitioner shall also file an undertaking affidavit before the trial Court that he will not indulge in any offence in future and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
