PRAYER :-Civil Revision Petition filed under Article 227 of The Constitution of India to set aside the fair and decreetal order dated 12.09.2024 in ELOP No.23 of 2020 on the file of the II Additional District Court, Thoothukudi.

ORDER

The Civil Revision Petition is filed against the fair and decreetal order dated 12.09.2024 in ELOP No.23 of 2020 on the file of the II Additional District Court, Thoothukudi.

2. Since no adverse orders are going to be passed against the respondent No.1, notice to the respondent No.1 is dispensed with.

3. The petitioner is the contesting candidate in the local body elections conducted in the year 2019. She has challenged the election of the 1st respondent as Panchayat President in EL. OP No.23/2020. The said petition came to be dismissed, against which, the petitioner is before this Court with this petition.

It is pertinent to note that the tenure of the officer bearers of the local body election is five years and in the case on hand, the election was conducted in the year 2019 and the five years period has also come to an end. Since the tenure of five years itself come to an end, the filing of Civil Revision Petition against the order in the election petition is not maintainable. Accordingly, the Civil Revision Petition is dismissed as nothing survives for adjudication. No costs.
