Mr.P.Muthusamy, learned counsel on record for writ petitioner; Mr.V.Kathirvelu, learned Senior Counsel and Assistant Solicitor General instructed by Mr.V.Malaiyendran, Central Government Standing Counsel on behalf of first respondent and Mr.B.Bhagawathi, learned Government Advocate on behalf of second respondent are before this Court.
2.Learned Assistant Solicitor submits, on instructions, that writ petitioner's application for issue of passport was closed on 08.08.2019 as writ petitioner had not responded to show-cause notices issued pursuant to his application. W.P(MD)No.21863 of 2019 3.Faced with the above situation, learned counsel for writ petitioner sought permission to withdraw instant writ petition, but made a plea that the rights of writ petitioner to make a fresh application to the first respondent for issue of passport may please be preserved.
4.Permitted to withdraw.
5.Learned counsel has made an endorsement in the case file. Endorsement is reiterated.
6.In the light of the endorsement and reiteration of the same, instant Writ Petition is dismissed as withdrawn albeit preserving the rights of the writ petitioner in the aforesaid manner. No costs.
