ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Writ Petition is filed seeking for a direction to the respondents 1 to 4 to remove the encroachments made by the respondents 5 to 11 and others in the
Government property situated in K.Pudur, Tallakulam revenue Village, Madurai North Taluk in Madurai Corporation Ward No.16 comprised in T.S.No.185 and it's subdivision including Sub Division Nos.185/1B, 185/1B1, 185/1H, 185/1B1H, etc., within a period of time that may be fixed by this Court.
2. Heard the learned counsel for the petitioner, the learned Government Pleader for the official respondents, the learned counsel for the second respondent and the learned counsel for the seventh respondent.
3. The learned Government Pleader submitted the records from the survey and re-settlement register and contended that even though originally, these lands were classified as European Quarters, subsequently, in the re-survey and settlement process, the lands are classified as Natham and they were converted to Town Survey Nos.86 to 88. The entire lands measuring an extent of 9.60 acres, after having been classified as Natham, were considered to be granted to the eligible beneficiaries. Pursuant to the process, the beneficiaries have been identified to be as many as 188 persons and pattas are to be granted to them to an area less than 3 cents, which they are eligible as per Revenue Standing Order 21. The Government Pleader also submits that the beneficiaries are yet to be granted patta.
4. It is made clear that the patta granted and conditions as contemplated under Revenue Standing Order 21 are to be scrupulously followed and complied with.
5. In view of the fact that already these lands have been converted as Natham under the re-settlement and beneficiaries have been identified and pattas are to be granted by the Government, the relief sought for by the petitioner in the Writ Petition, contending that the lands are belonging to the Government and the encroachments are to be removed, does not arise for consideration.
6. Accordingly, this Writ Petition stands dismissed. There shall be no order as to costs.
