PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the impugned Refusal Check Slip issued by the 3rd respondent vide his proceedings RFL/Aruppukottai/27/2025 dated 14.07.2025 and to quash the same as illegal and consequentially, to direct the 3rd respondent to register the executed sale agreement presented by the petitioner within a stipulated time fixed by this 1/4

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned Refusal Check Slip issued by the 3rd respondent vide his proceedings RFL/Aruppukottai/27/2025 dated 14.07.2025 and consequentially, to direct the 3rd respondent to register the executed sale agreement presented by the petitioner.

2. Through the impugned order, the respondents have traced the title and has stated that one Deivanaiammal is having four legal heirs. The respondents have also stated that the revenue documents also stand in the name of the four legal heirs. Therefore, the present sale agreement cannot be registered, which is executed by one of the legal heirs.

3.It is a settled proposition that revenue documents will not confer title. Through the impugned order, the respondents have determined the title of the other legal heirs, thereby acted as a Civil Court. Hence, the impugned refusal check slip is quashed and the respondents are directed to register the sale 2/4

agreement within a period of four weeks from the date of receipt of a copy of this order.

4.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
