ORDER
The petitioner with an allegation that the respondent police is harassing her under the guise of an enquiry has approached this Court. 2.The learned Government Advocate(Crl.side) appearing for the respondents 1 & 2 submits that earlier, the third respondent has lodged a complaint before the respondent Police, based on which, preliminary enquiry has been conducted in CSR.No.334 of 2025 and the same has been closed. Thereafter, the third respondent has filed a petition in Crl.M.P.No.4717 of 2025 before the learned Judicial Magistrate II, Madurai under Section 174 BNSS and the same has been forwarded to the respondent Police for enquiry. Therefore, the respondent Police issued summons to the petitioner and they are not harassing the petitioner.
3.Since the earlier complaint of the third respondent has been closed, the respondent Police shall conduct the enquiry, based on the direction of the learned Magistrate. In the event, if the complaint constitutes any cognizable offence, it is the duty of the respondent Police 2/4
to register a case. Without registering a case, they are not supposed to call the petitioner and harass him. Accordingly, this criminal original petition is disposed of.
