ORDER
Heard the learned counsel for the petitioner, learned Central Government Standing Counsel for the first respondent and the learned Government Advocate (Crl.side) for the second respondent.
2.This writ petition has been filed for a Mandamus to direct the first respondent to renew the petitioner's passport application bearing No.L5462106, by considering the application No.1000525803518525 dated 22.07.2025. 3.The petitioner is already a holder of a passport bearing Passport No.L5462106, which has valid between 01.11.2013 and 31.10.2023. 4.The petitioner has now filed an application for issuance of a fresh passport on 22.07.2025, which has been kept pending in view of the pendency of the FIR in Crime No.35 of 2020, dated 04.06.2020 before the second respondent 2/5
for the offences under Sections 188, 269, 420, 465 and 471 IPC and Section 3 of Epidemic Act, 1897 and Section 51(b) of the Disaster Management Act, 2005. 5.The learned Government Advocate (Crl.side) for the second respondent submits that a charge sheet has been filed before the Judicial Magistrate Court No.2, Ramanathapuram and the charge sheet has also been taken on file in C.C.No.245 of 2022, wherein, the petitioner has been arrayed as second accused. 6.Considering the same, there is no scope for granting any relief to the petitioner as prayed for. However, it is open for the petitioner to approach the learned Judicial Magistrate No.II, Ramanathapuram, in CC.No.245 of 2022 for appropriate orders for the first respondent to process the passport application of the petitioner.
