PRAYER :-For Bail in Crime No.646 of 2021 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/Accused NO.17, who was arrested and remanded to judicial custody on 27.09.2021 for the offence punishable under Sections 147, 148, 294(b), 302, 506(ii) alterned into 147, 148, 149, 294(b), 302, 506(ii) r/w 109, 120B and 212 of IPC in Crime No.646 of 2021, on the file respondent police, seeks bail. 2.The case of the prosecution is that one Abdul Kathar was murdered by the petitioner and other accused. Hence the complaint. 3.The learned counsel for the petitioner would submit that the petitioner had already moved a bail application before this Court and this Court by order dated 10.11.2021 had dismissed his bail application. This is a second Bail application before this Court. 4.The learned Additional Public Prosecutor would submit that the petitioner's brother one Martin was murdered by the deceased and that when the deceased came out on bail, at the instigation of the https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.18601 of 2021 petitioner, he was murdered by the other accused. He would further submit that out of 21 accused, 17 were already detained as Goondas under the Tamil Nadu Act 14 of 1982. He would further submit that the petitioner is the main accused and only at his instigation, the other accused had committed the alleged murder. The learned Additional Public Prosecutor would submit that there is no change in circumstances in this case.
5.Considering the seriousness and gravity of the offences and also the fact that the investigation is not yet completed and that there is no change in circumstances, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
