This Criminal Original Petition has been filed seeking to quash the FIR in Crime No.311 of 2020 on the file of the first respondent police, Page No. 2 of 11
registered against the petitioners for the offences punishable under Sections 147, 148, 294(b), 323, 324, 336, 506(2), 188 & 271 of the Indian Penal Code, 1860 and Section 3 of the Tamil Nadu Public Property (Prevention of Damage and Loss Act) 1992 and Section 3 of the Epidemic Diseases Act, 1897.
2. The allegation in the FIR is that, on account of a previous property dispute, the petitioners attacked the second respondent/defacto complainant and their relatives with rods, wooden logs, stones, and hands, abused them in filthy language, caused damage to an auto, and threatened them with dire consequences, and thus committed the aforesaid offences.
3. Admittedly, the petitioners and the second respondent/defacto complainant belong to the same village and are neighbours. There was a property dispute between them. The parties have now entered into a compromise and decided to give a quietus to the entire dispute. The parties, except the thirteenth petitioner, have filed a joint compromise memo dated 23rd April, 2025. The scanned copy of the compromise memo reads as follows:

Except the thirteenth petitioner, the other petitioners, namely, (1) Anand [Aadhaar No.6720 9150 2782], (2) Pandiyammal [Aadhaar No. 8457 0242 0327], (3) Arun [Aadhaar No.7258 6483 0585], (4) Surya [Aadhaar No.5828 5385 4483], (5) Nagaraj [Aadhaar No.8879 7940 7102], (6) Pothish @ Pothiraja [Aadhaar No.4441 5522 0505], (7) Karthick [Aadhaar No.6814 1625 8127], (8) Veerapandi [Aadhaar No. 3565 6133 4723], (9) Selvam [Aadhaar No.3306 4739 8033], (10) Elangovan [Aadhaar No.7591 9124 7864], (11) Thenpandi [Aadhaar No. 2849 3721 9839], (12) Pitchai [Aadhaar No.9103 7486 8764], (14) Sangilipandi [Aadhaar No.5877 8169 9106] and the second respondent/defacto complainant, namely, Vellaipandi [Aadhaar No.7127 8671 6732] are present before this Court in person. The parties are identified by Mr.M.
Murugappa, Special Sub-Inspector of Police, Karuppayoorani Police Station, Maurai District. The second respondent/defacto complainant confirmed that he does not wish to pursue the case against the petitioners, including the thirteenth petitioner; and that the other victims, who are the relatives of the second respondent/defacto complainant, have no objection to the quashing of the FIR.

Considering the nature of the offences and also considering the relationship between the parties, this Court is of the view that no useful purpose would be served by keeping the First Information Report (FIR) pending investigation. Accordingly, the impugned First Information Report (FIR) in Crime No.311 of 2020 on the file of the first respondent police, is quashed. The petitioners shall pay a sum of Rs.5,000/- as costs to the Mediation and Conciliation Centre attached to the Madurai Bench of Madras High Court forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
