ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 1/3
21.04.2024 for the offences punishable under Sections 5(1), 5(j)(ii), 5(n) r/w. 6 of POCSO Act, 2012 in crime No.10 of 2024, dated 20.04.2024 on the file of the respondent police, seeks bail.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and perused the materials available on record.
3. Considering the nature of allegations which is mentioned that the child aged about 15 years, just because it happened that living with her mother who was separated from the father and thereafter, got remarried, all these accused are continuously sexually abusing the child. This is not a fit case for enlarging the petitioner on bail.
4. It is now stated on behalf of prosecution that the charge sheet is filed and the case is taken on file as Special.C.C No.119 of 2024. However, it is also stated that the child has given birth also as the fetus could not be aborted. It is further stated the DNA samples have been taken from the accused persons as well as from the child and is already sent to the laboratory for examination. It is stated that the reports have not yet received. A copy of this order shall be forwarded to the appropriate laboratory by the respondent police and the appropriate laboratory may take steps to forward the report immediately as the accused are in incarceration. 2/3
