Prayer in WP(MD). 1161/ 2017 :

To issue a writ of Certiorarified Mandamus to call for the impugned order passed in Omu.No. 163/4/2016/M1 dated 20.07.2016 on the file of the 2nd respondent herein and to quash the same as illegal and direct the respondents to reimburse the medical expenses of Rs. 70,851/- as incurred by the petitioner, in accordance with law.

arguments of MR.P.SUBBARAJ, Special Government Pleader for the petitioner, the court made the following order:- Heard and perused.

2.The reasons stated in the accompanying affidavit for the delay in filing the counter in this Writ Petition are not acceptable to the Court, as no sufficient cause is shown by the petitioners/respondents. However, for proper adjudication of the issue involved in this case, the counter affidavit is very much essential.

3. Considering the same, this petition is allowed on condition of payment of cost of Rs.5000/- (Rupees five thousand only), to the credit of Account No.7567821433, Indian Bank, High Court Branch, Madurai in the name of Registrar Judicial, Madurai Bench of Madras High Court, Madurai, for donating law books to a Separate Section in the name of "Madurai Bench of Madras High Court" in Kalaignar Centenary Library, Madurai, by next date of hearing.
