PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to conduct an enquiry and cancel the illegal sub divisions made in S.No. 416/42 and to restore the same in the S.No.416/43 and S.No.416/4 and consequently, to direct the respondents not to lay thar road to erect or install any pipe line in S.No.416/42 (Present) without any acquisition of land from the petitioner, as per the representation made by the petitioner dated 08.08.2024.

O R D E R

This Writ Petition is filed directing the respondents to conduct an enquiry and cancel the illegal sub divisions made in S.No.416/42 and to restore the same in the S.No.416/43 and S.No.416/4 and consequently, to direct the respondents not to lay thar road to erect or install any pipe line in S.No.416/42 (Present) without any acquisition of land from the 2/6

petitioner, as per the representation made by the petitioner dated 08.08.2024.

According to the petitioner, he has given a representation dated 08.08.2024 to the respondents seeking cancellation of the illegal subdivisions made in S.No.416/42 and restoration of the same to S.No. 416/43 and S.No.416/4. Consequently, he also requested the respondents not to lay a tar road or erect or install any pipeline in S.No.416/42 (present) without acquiring the land from the petitioner. The petitioner contends that despite the submission of the representation, the official respondents have not taken any action to consider his representation. Hence, the present Writ Petition.

3. The learned Special Government Pleader appearing for the third respondent submits that the petitioner's representation will be considered and appropriate orders will be passed accordance with law, within a time frame to be fixed by this Court.

4. Recording the above submissions, this Writ Petition is disposed of, with a direction to the third respondent to consider the representation 3/6

of the petitioner, dated 08.08.2024, on merits and pass appropriate orders in accordance with law, after giving due opportunity to the petitioner, as well as all other persons, who may be interested in the subject matter, within twelve weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the third respondent to consider the same on its own merits. There shall be no order as to costs. Consequently, the connected Writ Miscellaneous Petition is closed.
