ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents to take necessary steps for reclassification of the private tanks known as "Chinna Kanmoi" and "Periakanmoi" as "lands" comprised in S.Nos.134/1 and 134/3, and consequently, restore possession and hand over the same to Sri Veerappa Vidhyalaya Paribalana Sabhai, Kullur Sandhai, Virudhunagar District, on issuance of Patta.

2. Heard the learned counsel appearing for the parties.

3. According to the petitioner, the petitioner Paribalana Sabhai is entitled to possession of the private tanks known as "Chinna Kanmoi" and "Periakanmoi," comprised in S.Nos.134/1 and 134/3, Kullur Sandhai, Virudhunagar District. The

petitioner has requested reclassification of these private tanks as "lands" and issuance of Patta in its name. Despite the lawful entitlement, the respondents have not taken necessary action to reclassify the tanks and restore possession. Hence, the present Writ Petition.

4. The learned Special Government Pleader for the respondents 1 and 2 submits that the petitioner's representation will be considered on its merits and in accordance with law.

5. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the respondents to consider the petitioner's representation dated 03.10.2018, on merits and in accordance with law and pass appropriate orders after providing reasonable opportunity of hearing to the petitioner and also to the other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order.
