O R D E R
[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] This Habeas Corpus Petition has been filed seeking a direction to the respondents 1 and 3 to produce, in person, the petitioner's daughter, viz., Vijaya Suriya, D/o. Thangamuthu, aged about 45 years.
2. The case of the petitioner is that the petitioner's daughter, viz., Vijaya Suriya, is a divorcee and she had been residing with her parents. While they were making arrangements for her second marriage, one Muthukumar, a resident of Thazhayuthu Village, Tirunelveli District, approached them and expressed his interest in marrying her. However, upon inquiry, the petitioner came to know that the said Muthukumar was involved in several criminal cases. Therefore, the petitioner refused to proceed with the marriage proposal. Despite this, Muthukumar contacted the petitioner's daughter through the phone number registered on her matrimonial profile. He allegedly took 25 sovereigns worth of gold jewellery from her and also recorded private and obscene videos, which he later used to threaten her. On 11.07.2025, at about 9:15 a.m., the petitioner's daughter informed the family that she was going to a tailor shop. However, around 9:30 a.m., when the petitioner's wife attempted to contact her, the phone Page No.2 of 5
was busy. Subsequent it was found the phone switched off. In these circumstances, the petitioner lodged a complaint with the second respondent, and a case was registered in Crime No. 251 of 2025 for "Woman Missing". However, no effective steps have been taken by the respondents to trace the whereabouts of the petitioner's daughter. Hence, the petitioner has filed the present Habeas Corpus Petition.
3. The learned Additional Public Prosecutor would submit that, based on the complaint given by the petitioner, a case in Crime No. 251 of 2025 was registered for "Woman Missing." During the course of investigation, the said Muthukumar was summoned and examined, and he stated that he had no connection with the disappearance of the missing person. Subsequently, during further investigation, on 05.08.2025, the missing person is said to have sent a WhatsApp message to one Rajachandran, a relative, from her mobile number 94865 82527, stating that she has got married. He further submits that steps are being taken to trace the missing person and that the respondents have also sought IDPR details in relation to the missing person.
4. Considering the facts and circumstances of the case, and taking into account that the respondents are actively taking steps to trace the missing Page No.3 of 5
woman, this court directs the third respondent to continue the investigation and trace the missing person at the earliest. The second respondent is directed to monitor the progress of the investigation.
