Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL UNDER SECTION 482 OF BNSS PRAYER :- To enlarge the petitioner on the bail in the event of his arrest in S.C.NO.443 of 2023 on the file of the Principal District Court, Madurai, in connection with Crime No. 169 of 2021 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner, who is an accused in S.C.NO.443 of 2023 on the file of the * V Additional District and Sessions Judge, Madurai, has filed this application seeking anticipatory bail. The said case was registered for the offence under Sections 109, 307, 302, 147, 148, 149, 342, 506(ii) of IPC and Section 83(2) of the Juvenile Justice (Care and Protection of Children) Act, 2015, in Crime No.169 of 2021 on the file of the respondent police.

2. The petition is filed for grant of anticipatory bail.
3. It can be seen that the petitioner has earlier been arrested and released on bail and for the hearing on 31.01.2024, the petitioner did not appear before the trial court. As such, non bailable warrant was issued. The non bailable warrant was issued for non-appearance, it is for the petitioner to file application to recall the warrant and anticipatory bail cannot be granted for that purpose.
4. Therefore, the Criminal Original Petition is disposed of with liberty to the petitioner to file an application to recall the warrant, and when the petitioner surrenders before the court and files such an application, the same shall be considered by the trial court.
