Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, direct the respondent Nos.1 to 5 to initiate appropriate action against the eighth respondent on the basis of the petitioner's representation, dated 02.03.2015, consequently to direct the respondent Nos.1 to 5 to issue necessary direction to the eighth and ninth respondents to permit the petitioner's daughter, namely, Bindiya, who studying 6th standard "A" section in the eighth respondent school to continue her study without any discrimination in ninth respondent school and to provide free education to the petitioner's daughter, namely, Bindiya under 25% free education reservation quota under Right to Education Act in the eighth respondent's School.

ORDER

The present Writ Petition has been filed for a Writ of Mandamus, directing the official respondents to initiate action as against the eighth and ninth respondents.

2. According to the learned Counsel for the petitioner, his daughter was ill-treated by the staff members of the School and was compelled to pay the entire fees. According to the learned Counsel for the petitioner, the petitioner's daughter is eligible to be considered under 25% free education reservation quota under the Right to Education Act in the eighth respondent School.

3. The learned Government Advocate appearing for the official respondents brought to the notice of the Court that the same petitioner had filed Crl.O.P(MD)No.15624 of 2014 for registering an FIR on the 3/6

basis of the complaint lodged by the writ petitioner as against the same School on 18.07.2015. In the said proceedings, the petitioner and his daughter have appeared before the Court and they have submitted that the daughter was admitted to a different School on 02.09.2015. That apart, on the basis of the allegations, the District Collector had submitted a report and the said report was accepted by this Court and the complaint was closed.

4. In view of the above orders passed in Crl.O.P(MD)No.15624 of 2014, this writ petition has become infructuous and the same is closed. There shall be no order as to costs. Consequently, connected Miscellaneous Petition stands closed.
