PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents 1 to 4 to forbear the 5th respondent from carrying out the quarrying activity in Survey Number 2/3, 2/6 and 2/7 at Kottayur village of Virudhunagar Taluk and District, based on the petitioners representation dated 12.09.2018.

[Order of the Court was made by R.MAHADEVAN, J.] The prayer in this writ petition is for issuance of a writ of mandamus directing the respondents 1 to 4 to forbear the fifth respondent from carrying on quarrying activities in Survey Nos.2/3, 2/6 and 2/7 of Kottayur Village, Virudhunagar Taluk and Virudhunagar District, based on the petitioner's representation dated 12.09.2018.

2. The learned Additional Government Pleader appearing for the respondents 1 to 4, on instructions, submitted that no illegal quarrying

operation is carried on in Survey Nos.2/3, 2/6 and 2/7 of Kottayur Village, as alleged by the petitioner, and to that effect, he has also produced a copy of the communication in Na.Ka.KV1/1229/2022, dated 16.09.2022 of the Assistant Director, Mines and Geology Department, Virudhunagar.

3. Recording the above submission of the learned Additional Government Pleader, this writ petition is closed. However, it is open to the petitioner to approach the authority concerned, if any illegal quarrying operation is noticed in the subject property. No costs.
