Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the official respondents.
2. Issuance of notice to the private respondents is dispensed with.
3. The petitioner alleges that survey No.309/24 Mavilangai Village is a water-body and that there are encroachments therein. He wants the same to be cleared.
4. When the matter was taken up for hearing, the learned Additional Government Pleader submitted that as per the revenue records, the petition-mentioned survey number has been classified as 2/4
3 W.P.(MD)NO.21251 OF 2024 Mavilangai Oorani. It is further undertaken that survey will be taken up and if the encroachments are noticed, they will be cleared. We record the aforesaid undertaking. We give specific direction that due process of law shall be properly adhered to. All the encroachers shall be put on notice while conducting survey. The entire exercise shall be completed within a period of five months from the date of receipt of a copy of this order. This writ petition stands disposed of accordingly. No costs.
