Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the fourth respondent to return back the 10th Mark Statement and Transfer Certificate (TC) of petitioner's daughter, namely, Bhavadharani (SPR No.481), by mentioning that she has passed 11th standard without insisting outstanding of fees within the time frame. This Writ Petition has been filed in the nature of Mandamus seeking a direction to the fourth respondent/the Correspondent, Mount Zion Silver Jubilee Matriculation Higher Secondary School, Sivagangai District, to return back the 10th Mark Statement and Transfer Certificate to the daughter of the petitioner/Bhavadharani by mentioning that she had passed 11th standard. 2.Heard Mr.P.T.Ramesh Raja, learned Counsel for the petitioner, Mr.S.Kameswaran, learned Government Advocate for R1 to R3 and Ms.A.Banumathy, learned Counsel for the fourth respondent. https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.21028 of 2021 3.During the course of hearing, Ms.A.Banumathy, learned Counsel for the fourth respondent submitted that the fourth respondent School had actually returned back all the necessary certificates to the daughter of the petitioner herein. That controversy does not therefore exist.

4.But, however, the further issue is that the daughter of the petitioner should be accommodated in some other Government School and for that, Mr.S.Kameswaran, learned Government Advocate had informed that Bhavatharani can join in Thirupathur Nagappa Maruthappa Government Girls Higher Secondary School, Sivagangai in 11th Standard for the academic year 2021-22 but must join on or before 20.12.2021.

5.A direction is given to the Head Master, Thirupathur Nagappa Maruthappa Government Girls Higher Secondary School, Sivagangai, even though the said School is not a party to the Writ Petition, to admit Bhavatharani, daughter of Velmurugan and V.Janaki, residing at 32B, Sowmiya Narayanapuram, Devarampur Road, Pudukkattampur- 630 210, Sivagangai District, in 11th Standard for the academic year 2021-22 and necessary fees will have to be naturally paid by the petitioner herein.

6.With the said observations, this Writ Petition is allowed. No costs.
