Respondents PRAYER: Writ Petition under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, directing the 2nd respondent to call for the records in his proceedings in Na.Ka.No.4306/2010 nela. Dated 21.04.2014 and quash the same and consequently directing the respondents to provide terminal benefit amount to the petitioner i.e., EPF balance amount Rs.2,08,205/- and adjusted amount of Rs.3,53,175/- with interest at the rate of 12% P.A. from the date of retirement to the date of realization. O R D E R

The grievances of the writ petitioner is that the Deputy Registrar of Co-operative Societies, Palani Region, passed an order on 21.04.2014 stating that the terminal and pensionary benefits of the writ petitioner has been adjusted and there is no due to pay any amount to the petitioner.

2. Admittedly, the said order is passed by the Deputy Registrar of Co-operative Societies and the Writ Petitioner has to approach the Regional Joint Registrar of Co-operative Societies, under https://hcservices.ecourts.gov.in/hcservices/

W.P.(MD)Nos.3703 of 2015 Section 153 of the Tamil Nadu Co-operative Societies Act, for the purpose of redressing his grievances.

3. When an efficacious remedy is available under the provisions of the Act, the petitioner has to exhaust the remedy before approaching the Court of Law. This being the factum, the petitioner is at liberty to approach the Competent Revisional Authority, by filing a Revision Petition under Section 153 of the Tamil Nadu Cooperative Societies Act, for the purpose of redressal of his grievances, in the manner known to law.

4. With these observations, the writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petitions is closed.
