Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for respondents 1 and 2 and the learned counsel appearing for the third respondent. 2.The petitioner states that he has obtained decree in O.S.No.198 of 2012 on the file of the District Munsif, Dindigul and that the third respondent who is a subsequent purchaser is not honouring the decree. On the other hand, learned counsel appearing for the third respondent would claim that the property had been purchased by the third respondent even before passing of the decree. He would point out that the decree is an ex-parte decree. He also stated that the suit filed by both the petitioner as well as the third respondent is pending before the jurisdictional civil Court. When the jurisdictional civil Court is seized of the matter, the question of deciding the issue under Section 482 of Cr.P.C. does not arise.
