ORDER

This Writ Petition has been filed seeking a writ of mandamus to direct the first respondent to consider the petitioner's representation dated 18.03.2025.

2. The claim of the petitioner is that his family owns lands measuring 6 acre 60 cents in S.Nos.114 and 115, M.Puthur Village, Thotiyam, Trichy District. After the petitioner's father passed away on 12.05.2005, his mother, himself and other siblings have inherited the same and they are in possession and enjoyment of the same. The lands are punja lands and 300 coconut trees and 200 mango trees are present there. The father of the petitioner had a civil dispute against the nearby land owners in O.S.No.302 of 1991 on the file of the District Munsif Court, Musiri and had got a decree for permanent injunction on 10.11.1992. His father had also filed a writ petition in W.P.No.7835 of 1996 for a direction for granting patta and appropriate direction has also been given in the said petition to the Tahsildar, Musiri on 21.01.2004.

Subsequent to the death of the petitioner's father, the petitioner filed an another writ petition seeking the same relief as the patta has not been granted as directed earlier. However, the Tahsildar, Musiri rejected his claim on 04.03.2016.

Revenue Officer, Trichy on 19.04.2016 and the same is still pending. As the petitioner and his family members were facing threats, the petitioner filed a petition in Crl.O.P.(MD)No.9103 of 2016 to give police protection and in that also a direction has been given by the Court to consider the representation of the petitioner.

Despite the petitioner has been enjoying the property without any interruption, some third parties are trying to forge documents as though they have ownership over the lands with the help of Tahsildar, Revenue Inspector and Village Administrative Officer. In connivance of the Government Officers, revenue records have been produced and in pursuant to that various transactions have been effected by executing registered documents. Despite the petitioner had given a representation to the respondent on 18.03.2025 to take necessary action on the allegations made by him, no action has been taken so far.

Mr.C.Muthusaravanan, learned Special Public Prosecutor for CBI, who takes notice for the first respondent submitted that the whole of the representation made by the petitioner revolves around the civil dispute and there is no role for the CBI to play. Even then, on getting the representation of the petitioner, the first respondent has forwarded the 3/5

same to the second respondent on 01.07.2025 and now the matter is lying with the second respondent.

5. Mr.S.Vinodh, learned counsel who takes notice for the second respondent has submitted that if the petitioner chooses to appear before the second respondent, the matter will be enquired and the representation of the petitioner can be given quietus.

Taking into consideration of the said submission, I feel it is sufficient to dispose this petition by directing the second respondent to summon the petitioner and all the respondents pointed out by him and pass appropriate orders on the representation of the petitioner dated 18.03.2025, after considering their submissions and the proceedings pending before the District Revenue Officer, Trichy within a period of four weeks from the date of receipt of a copy of this order.

7. With the above direction, this Writ Petition (Crl.) is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed. 22.08.2025 mbi 4/5
