Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records in pursuant to the order passed by the third respondent in his proceeding 1/4

Na.Ka.No.(EMEPO) Uu/Av/Ko.Pu.V/Va Vu/Number 300/15 dated 04.03.2015 quash the same and directing the respondents to provide new Electricity Connection in the petitioner's residential plot No.1637, Mela Anuppanadi, Tamil Nadu Housing Board.

ORDER

None appears for the writ petitioner. Heard the learned Standing Counsel appearing for the respondents.

2. I went through the contents of the affidavit filed in support of the writ petition.

3. It is seen that the petitioner is the owner of the petition mentioned premises. He had given authorization in favour of the third parties and allowed them to enjoy premises. During such enjoyment, the third parties had committed energy theft. Therefore, assessment charges were levied. Since it was not paid, the service connection was also cut off. Thereafter, the petitioner sought fresh connection. The authorities made it clear that unless the 2/4

assessment and Belated Payment Charges (BPSC) are paid, reconnection cannot be granted. To this effect the impugned communication was signed. That is put to challenge in this writ petition.

4. I am satisfied that the impugned communication is very much in consonance with the provision of Tamil Nadu Electricity Supply Code. Interference is not warranted.

5. This writ petition stands dismissed. There shall be no order as to costs.
