[R5 is impleaded as per order dated 07.01.2026, made in W.M.P.(MD)No.1391 of 2023] PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the third respondent to rectify the error and issue Patta in the name of R.Varathan (the petitioner) for the property comprised in Survey No.2300, Ward C, Block 42, measuring about 3 Acres and 37 Cents in Thimaraya Samuthiram Village of Trichirappalli District. ORDER

This writ petition has been filed seeking issuance of a Writ of Mandamus, directing the third respondent to rectify the error and issue the Patta in the name of the petitioner for the property comprised in Survey No.2300, Ward C, Block 42, measuring approximately 3 acres and 37 cents, located in Thimaraya Samuthiram Village, Trichirappalli District.

2. Heard the learned counsel appearing for the parties.

3. According to the petitioner, he is in peaceful possession and enjoyment of the property in question. He has faced an error in the Patta issued for the above property. Despite being the lawful owner, the Patta has not been issued in the name of the petitioner. Hence, the petitioner submitted a representation dated 13.12.2017 to the third respondent seeking to rectify the aforementioned error and issue the Patta in his name, as per the relevant land records. Since the same has not been considered so far, the petitioner has filed the present Writ Petition for the relief stated supra.

4. The learned Government Advocate appearing for the respondents 1 to 4 submits that the petitioner's representation will be considered on merits and in accordance with law.

Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 13.12.2017, on merits and in accordance with law and pass appropriate orders after providing reasonable opportunity of hearing to the petitioner, and any other persons, who

may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.)
