This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first and second respondents to cancel the order of the third respondent in Ni.Mu.No.35018/2015/G5 dated 07.12.2020 and to restore the land comprised in S.No.184/5, measuring an extent of 0.24.5 ares, in Old Patta No.787, situated at Nadukottai Village, Thirumangalam Taluk, Madurai District, on the basis of the petitioner's representation dated 03.08.2023, within the time stipulated by this Court.
2. The grievance of the petitioner is that the subject property originally belonged to the sister of the petitioner's mother, who died issueless. During her lifetime, the petitioner's mother was in possession and enjoyment of the property and was taking care of her. The patta was also mutated in the name of the petitioner's mother. After the demise of the petitioner's mother, the petitioner and the other legal heirs inherited the same.
3. While so, the eighth respondent, along with certain villagers, fabricated bogus documents and attempted to grab the said property. The suit filed by the petitioner was decreed in his favour. However, the third to Page No. 3 of 7
fifth respondents illegally mutated the patta and included the name of the eighth respondent along with the petitioner's family members.
4. Therefore, the petitioner submitted a representation dated 03.08.2023 seeking cancellation of the order of the third respondent dated 07.12.2020, by which the patta was mutated and restoration of its earlier position. Since the same has not been considered, the petitioner has been constrained to file the present Writ Petition.
5. The learned Additional Government Pleader appearing for the first to seventh respondents, on instructions, would submit that the petitioner's representation dated 03.08.2023 would be considered and appropriate orders would be passed by the first and second respondents within a period of sixteen weeks.
6. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first and second respondents to consider the petitioner's representation dated 03.08.2023 and pass appropriate orders on its merits and in accordance with law within a period of sixteen weeks from the date Page No. 4 of 7
of receipt of a copy of this order. The representations shall be disposed of after conducting an enquiry. The first and second respondents are also directed to provide a reasonable opportunity of hearing to the petitioner, the eighth respondent and any other interested parties who may be affected by such decision, before passing any order. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
