ORDER
The Writ Petition has been filed seeking orders to direct the respondents 1 and 2 to conduct proper enquiry pursuant to the C.S.R.No. 93 of 2024 and representation dated 28.03.2024 on the file of the second respondent as expedite as possible and pass suitable or other orders as this Court may deem fit and proper in the circumstances of the case.
2. Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents 1 and 2 and Mr.S.Saravanan, learned counsel takes notice for the third respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself.
3. When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondents 1 and 2 would submit that on the basis of the complaint given by the writ 2/6
petitioner, CSR No.93 of 2024 came to be registered and after enquiry, the same was ordered to be closed.
4. The learned counsel appearing for the writ petitioner would submit that subsequent to the closure of the earlier complaint, the writ petitioner has given a representation dated 28.03.2024 but there was no action.
5. The learned counsel appearing for the third respondent would submit that the writ petitioner's husband had obtained loan from the third respondent Bank and when the same was demanded, they came to know that the writ petitioner's husband died and there was no harassment by the third respondent.
6. Since the writ petitioner's representation dated 28.03.2024 is pending before the second respondent, the second respondent is directed to issue written summons to the writ petitioner as well as to the private respondent and conduct enquiry and take a decision within a period of two weeks from the date of receipt of a copy of this order. 3/6
7. With the above direction, the Writ Petition stands disposed of. No costs.
