For Respondent : Mr.M.Karunanithi, Government Advocate (Crl.Side) PETITION FOR MODIFICATION Under Sec.528 of BNSS PRAYER :- To set aside the order in Crl.MP.No.3311 of 2025 dated 21.07.2025 passed by the learned Principal Sessions Court Tirunelveli and modify the condition of the petitioner sign before the respondent police to Natrampatti Police Station, Tirupathur District.

ORDER : The Court Made the following order :- This petition has been filed to modify the condition (iii) imposed in Crl.MP.No.3178 of 2025 dated 16.07.2025 on the file of the learned Principal Sessions Judge, Tirunelveli.
2. The learned counsel for the petitioner would submit that this petitioner was arrested and remanded to judicial custody on 14.06.2025. This petitioner had filed a bail application before the learned Principal Sessions Judge, Tirunelveli and the Trial Court had granted bail to the petitioner by way of order dated 16.07.2025 with certain conditions. The said condition (iii) is as follows:- '' (iii) The Petitioner shall report and sign before the respondent police station, daily at 10.00a.m. for a period of one month and further respondent police is directed to submit the report, deviations if any committed by the petitioner in observing the above conditions. On further condition that she shall make available herself for interrogation as and when required by the investigation Officer. ''
3. He further submits that this petitioner complying the said condition regularly. This petitioner is aged about 47 years old lady and she having children. This petitioner is residing at Tirupathur and the distance between Tirupathur to Tenkasi for nearly 400 Kilometres. This petitioner travelling for more than eight 2/4
hours to Tenkasi to comply the said condition. She finds it very difficult to appear and sign before the respondent police station. Hence, the petitioner seek indulgence of this court by modifying the said condition imposed against her. This petitioner had already filed a modification petition before the learned Principal Sessions Judge, Tirunelveli in Crl.M.P.No.3311 of 2025. But, the trial Court by way of order dated 21.07.2025 dismissed the said modification petition. Hence, he prays for modification of the said condition.
4. The learned Government Advocate (Crl.side) appearing for the respondent has not raised any objection to allow this Criminal Original Petition.

Considering the submissions made by the learned Counsel for the Petitioner and being satisfied with the reasons stated above, this Court is inclined to modify the condition in the order made in Crl.MP.No.3178 of 2025 dated 16.07.2025. Accordingly, Condition No.(iii) is modified as ''(iii) The Petitioner shall report and sign before the Inspector of Police, Natrampatti Police Station, Tirupathur District daily at 10.00a.m. until further orders.''. The other conditions shall remain unaltered.
