Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order passed by the 2nd respondent in Na.Ka.No. 3643/Aa1/2021-4 dated 07.03.2024 quash the same and consequently directing the 3rd respondent to register the petitioner's sale deed in S.No.96/2B of Valayapatti Village of Melur Taluk, Madurai, based on the patta issued by the 5th respondent in Na.Ka.No.K5683/20/C1 dated 31.12.2020. ORDER

This writ petition has been filed for a Writ of Certiorarified Mandamus to quash the impugned order passed by the 2nd respondent in Na.Ka.No. 2/6

3643/Aa1/2021-4 dated 07.03.2024 and consequently directing the 3rd respondent to register the petitioner's sale deed in S.No.96/2B of Valayapatti Village of Melur Taluk, Madurai, based on the patta issued by the 5th respondent in Na.Ka.No.K5683/20/C1 dated 31.12.2020.

2. Through the impugned order the respondents have stated that there is a third party objection. Further, there is a litigation between the petitioner and the private respondents. Moreover, a suit in O.S.No.172 of 2008 for permanent injunction was filed and the same was contested and dismissed. Against which the private respondents preferred an appeal and the same was dismissed for non prosecution. The same is recorded in the impugned order. Further, the respondents have stated that the petitioner has not submitted the relevant documents. Hence, the present sale deed was refused to register. 3.This Court is of the considered opinion that when the suit has ended in favour of the petitioner, then the official respondents ought to consider the petitioner's sale deed. Therefore, the impugned order shows the non application of mind of the authorities. Therefore the impugned order dated 07.03.2024 is quashed. However, the petitioner ought to submit the relevant documents before the authorities. Hence, the petitioner is directed to submit all the relevant 3/6

documents before the authorities within a period of two weeks from the date of receipt of a copy of this order. On such submission, the third respondent shall consider the same within a period of four weeks therefrom. 4.With these directions, this Writ Petition is allowed. No Costs.
