ORDER

The petitioner has lodged a criminal complaint against the 3rd respondent that she received some amount from the petitioner by promising to arrange a government job for him and thereby cheated him and an FIR in Crime No.14 of 2022 dated 23.05.2022 was registered on the file of the Theni District Crime Branch for the same. The petitioner has also made some representations to the 1st respondent seeking disciplinary action against the 3rd respondent alleging that she had acted against the code of conduct. In the meantime, the 3rd respondent attained the age of superannuation and retired from service on 30.06.2023. Therefore, the petitioner has filed this writ petition seeking a writ of mandamus to direct respondents 1 and 2 not to disburse the 3rd respondent's retirement benefits by considering his representation dated 31.07.2023.

2. It is reported that the retirement benefits due to the 3rd respondent has already been disbursed.

3. Since the retirement benefits have already been disbursed to the 3rd respondent, nothing further survives in this writ petition. Accordingly, this writ petition is dismissed with liberty to the petitioner to recover the amount in the manner known to law. No costs.
