(Order of the Court was made by A.D.JAGADISH CHANDIRA, J.) This writ petition has been filed for issuance of a writ of Mandamus, directing the respondents not to grant permission to open a TASMAC Bar in the name of 'Manamahil Mantram' at Survey Nos.295/2A and 295/2B, Senkottai to 2/7
Kollam Main Road, Pudur Town Panchayath, Senkottai Taluk, Tenkasi District, based on the petitioner's representation dated 30.06.2025, within a stipulated time frame.
2. Heard Mr.A.D.Ganeshamoorthi, learned counsel for the petitioner; Mr.P.Thilak Kumar, learned Government Pleader, who accepts notice on behalf of the respondents 1 and 5; and Mr.S.Sivanesan, learned Standing Counsel, who accepts notice on behalf of the respondents 2 to 4.
3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. Having regard to the nature of the order proposed to be passed in this writ petition, notice to the sixth respondent is dispensed with.
4. The petitioner asserts that the fourth respondent has granted a license to construct and open a TASMAC bar on the edge of the Senkottai - Kollam National Highway, in an agricultural paddy field, where a Temple, Schools and several residential houses are located nearby. The grievance of the 3/7
petitioner is that, although a TASMAC shop is already functioning just 300 meters from the proposed location, the fourth respondent has now granted a license to open an additional TASMAC bar. In this regard, the petitioner submitted a representation dated 30.06.2025 requesting not to grant permission to open the TASMAC bar in the said survey numbers. However, since no action was taken on the said representation, the petitioner has now approached this Court by filing the present Writ Petition.
5. Learned counsel for the petitioner would further submit that the petitioner would be satisfied if a direction is issued to the first respondent to consider the representation of the petitioner dated 30.06.2025 and pass appropriate orders thereon, within a time frame to be fixed by this Court.
6. Considering the above facts and circumstances, without going into the merits of the case, this Writ Petition is disposed of with a direction to the first respondent, to consider the representation of the petitioner dated 30.06.2025 and pass appropriate orders in accordance with law, after affording an opportunity of hearing to all the parties concerned. Such exercise shall be completed as 4/7
expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the fourth respondent to consider the same on its own merits.
