PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to consider petitioner's representation dated 31.07.2024, and to disburse the pension benefit from the petitioner date of superannuation in form of AAI Employees Defined Contribution Pension Scheme.

ORDER

The present Writ Petition has been filed by a retired employee of the first respondent establishment seeking a mandamus to consider his representation dated 31.07.2024.

2.A perusal of the records reveal that the petitioner has retired as a General Manager(Finance) from the first respondent establishment on 31.03.2012. According to the learned Counsel appearing for the writ petitioner, he is eligible for the benefits under the Pension Scheme from the year 2017, onwards. Seeking the said benefits, the petitioner has sent a representation to the first respondent on 31.07.2024. Since there is no response, the present Writ Petition has been filed.

3.Considering the above said facts, the first respondent is directed to consider the representation of the petitioner dated 31.07.2024, and pass orders on merits and in accordance with law within a period of 12 (twelve) weeks from the date of receipt of a copy of this order.

4.With the above said observations, this Writ Petition stands disposed of. No costs.
