PRAYER :-Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents herein to forthwith to disburse the grant-in-aid towards the arrears of salary and to revise the pay of the petitioner as Assistant Professor in the Department of Hindi in the 5th respondent College namely Lady Doak College, Madurai from 24.07.2013 to 03.12.2015 along with all attendant benefits in the light of the proceeding of the respondents 3 and 4 in Na.Ka. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself. 2.The writ petition has been filed for a mandamus directing the respondents herein to forthwith to disburse the grant-in-aid towards the arrears of salary and to revise the pay of the petitioner as Assistant Professor in the Department of Hindi in the 5th respondent College namely Lady Doak College, Madurai from 24.07.2013 to 03.12.2015 2/5
along with all attendant benefits in the light of the proceeding of the respondents 3 and 4 in Na.Ka. No.39268/G2/2021 dated 12.04.2021 and Pa.Mu. No.4356/u3/2021 dated 29.04.2021 respectively.
3. The petitioner was appointed as an Assistant Professor in the 5th respondent College and her appointment was also approved by the educational authorities on 04.12.2015. It is submitted that though the petitioner's appointment was approved by the official respondents, the respondents have not disbursed the arrears of salary from 24.07.2013 to 03.12.2015. Hence, the petitioner has given a representation to the respondents. However, since the said representation has not been considered so far, the petitioner is before this Court.
4. I have considered the rival submissions and perused the materials available on record.
5. Considering the facts and circumstances of the case and in view of the limited relief sought for by the petitioner, the writ petition is disposed of with a direction to the 5th respondent to send necessary 3/5
proposal to the third respondent within a period of one week from the date of receipt of a copy of this order. On receipt of the same, the third respondent is directed to pass appropriate orders within a period of four weeks thereafter, if the petitioner is eligible for the salary for the aforesaid period. No costs.
