the proposed construction of the security room and as per the reminder dated 20.07.2023, in the plot situated in S.Nos.1157/1 and 1156/4B, in Thenmalai Village, in Sivagiri Taluk, in Thenmalai Village Panchayat limits, in Vasudevanallur Panchayat Union, in Tenkasi District, within a time frame under the Village Panchayat Act and Rules.

ORDER

The present writ petition has been filed seeking a mandamus directing the respondents 2 and 3 to approve the plan submitted by the writ petitioner for the proposed construction of the security room and as per the remainder dated 20.07.2023.

It could be seen from the records that the petitioner had put up unauthorised construction in S.Nos.1157/1 and 1156/4B in Thenmalai Village in Sivagiri Taluk, Vasudevanallur Panchayat Union, Tenkasi District. A building plan approval has not been obtained. However, a forged building plan was created, for which FIR has been registered as against the writ petitioner and the concerned Village Panchayat Secretary in Cr.No.3 of 2021, dated 19.11.2021. 2/4

3. The present writ petition has been filed seeking a direction to the respondents for the construction of the security room. In paragraph No.13 of the counter, it has been pointed out that already security room has been constructed and the said fact has been suppressed in the writ petition.

4. Considering the fact that the petitioner has already put up unauthorised construction of building as well as the security room, question of issuing a mandamus does not arise.

5. There are no merits in the writ petition. Accordingly, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is also closed.
