ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police, for the offence punishable under section 379 IPC r/w Section 21(1) of Mines and Minerals (Development and Regulation Act, 1957, in Crime No.688 of 2021, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner has illegally transported 1⁄2 unit of sand by using TATA ACE. Hence, the complaint.
3.The learned counsel appearing for the petitioner submits that this is the third petition filed by the petitioner for anticipatory bail. The earlier petitions were dismissed by this Court on 19.08.2021 and 28.09.2021.He further submits that the petitioner is ready to abide by any conditions imposed on him by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submits that this is the third anticipatory bail petition. Earlier petitions filed by the petitioner for anticipatory bail were dismissed on the ground that seven previous cases are pending against this petitioner.
5.But the learned counsel for the petitioner denied the same and state that only one case is pending against him. 6.In reply, the learned Government Advocate submits that not only the petitioner is having seven previous cases but also, he is a history sheeted rowdy. 7. Considering the antecedents of petitioner, and since there is no change in circumstances, after the dismissal of earlier petitions, this Court is not inclined to grant anticipatory bail to the petitioner.
