Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the third respondent to disburse Rs.62,010/- spent by the petitioner for the treatment underwent by him by considering the communication of the fourth respondent dated 22.01.2021 within a stipulated time fixed by this Court. ORDER
This writ petition has been filed seeking a direction to the third respondent to disburse the sum of Rs.62,010/- spent by the petitioner for the treatment underwent by him by considering the communication of the 2/6
fourth respondent dated 22.01.2021 within a stipulated time fixed by this Court.
2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.
3. The learned counsel appearing for the petitioner would submit that the petitioner was employed as a Secondary Grade Teacher in a Government-Aided School, Kanyakumari District. Thereafter, the petitioner retired from service on 30.06.2008 on attaining the age of superannuation. Due to a sudden illness, the petitioner underwent surgery. The entire surgery fee was paid by the petitioner, and in order to get reimbursement of the said amount along with other expenses towards the surgery from the medical reimbursement claim, he submitted a representation to the respondents. However, the same was not considered by the respondents. Subsequently, the petitioner filed a Writ Petition before this Court in W.P.(MD) No.8045 of 2020, and this Court, by an order dated 27.07.2020, directed the respondents to consider the petitioner's representation. Immediately on receiving the said order, the fourth respondent herein sent a communication to the third respondent in 3/6
Na.Ka.No.4812/2020/S2, dated 22.01.2021 for further proceedings, stating that the petitioner's claim was approved by the District Level Empowered Committee. However, till date, the respondents have failed to disburse the said amount. Hence, the petitioner has filed the present Writ Petition.

The learned Additional Government Pleader appearing for the State would submit that prior to filing of the Writ Petition, out of Rs.62,010/-, Rs.35,020/- was disbursed to the petitioner on 30.10.2023. The petitioner has to approach the District Level Empowered Committee to claim the remaining balance amount.
5. In view of the above, the Writ Petition stands dismissed. Liberty is granted to the petitioner to work out his remedy for claiming the balance amount before the appropriate authority in the manner known to law. No costs.
