The Writ Petition is filed challenging the order passed by the third respondent allowing the application filed by the seventh respondent seeking issuance of patta in his name in respect of the property in S.No.9/1A1A1 situated at Ramankulam Village, 2/6
Madurai South Taluk, Madurai.
2.Mr.A.Baskaran, learned Additional Government Pleader takes notice for the respondents 1 to 5. By consent of both parties,the Writ Petition is taken up for final disposal at the admission stage itself.
3.A reading of the impugned order would suggest that the Petitioner had effectively participated in the enquiry before the Third Respondent/Tahsildar and a copy of the impugned order was also served on the Petitioner. Hence there is no violation of natural justice principles. Against the impugned order, statutory remedy of appeal available to the Petitioner under Section 12 of the Patta Passbook Act before the first respondent. Against the order passed by the first respondent in appeal, further remedy of revision is available to the Petitioner under Section 13 of the Patta Passbook Act before the District Revenue Officer. In view of the availability of alternative remedy before the hierarchy of authorities, this Court is not inclined to entertain the present Writ Petition.
4.Accordingly, the Writ Petition is dismissed, with liberty to the Petitioner to avail the statutory remedy of appeal before the 3/6
first respondent. Registry is directed to return the original impugned order to the learned counsel for the Petitioner. No costs.
