..Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records of the respondent's impugned E-Auction Notice in A/000740/2025 dated 16.07.2025 published in the Tamil Daily Newspaper of Dhinakaran dated 19.07.2025 and quash the same as it violates the Article -14 and 15 of the constitution of India and consequently direct the respondent to allot the shops to the existing shop keepers under clause 3 (X) of the G.O.(2u) No.66 dated 06.08.2024 in Madurai Town East Market Daily Market by considering the petitioner's representation dated 11.09.2023, 1/4

ORDER

The petitioner challenges the E-auction Notice dated 16.07.2025 issued by the respondent inviting bids for allotment of shops and seeks a consequential direction to the respondent to allot the shops to the existing shopkeepers in terms of Clause 3(X) of G.O.(2D) No.66, dated 06.08.2024.

2.The learned Standing Counsel appearing for the respondent submitted that the validity of the aforesaid Government Order was challenged before this Court in W.P.(MD) No.3695 of 2025. This Court, by order dated 03.06.2025, allowed the said writ petition and set aside Clause 3(X) of G.O.(2D) No.66, dated 06.08.2024. This Court further directed that the allotment of shops shall be made only through public auction in accordance with the Tamil Nadu Urban Local Bodies Rules, 2023. 3.The learned Standing Counsel further submitted that the members of the petitioner Association have also participated in the e-auction process conducted pursuant to the impugned notification.

4.In view of the fact that Clause 3(X) of G.O.(2D) No.66, dated 06.08.2024, on which the petitioner places reliance, has already been set aside by this Court, the relief sought for in the present writ petition no longer survives for consideration. 5.Further, the members of the petitioner Association having participated in the e-auction process, no useful purpose would be served by keeping the writ petition pending.

6.Accordingly, the writ petition stands disposed of as infructuous. There shall be no order as to costs. Consequently, the connected miscellaneous petitions are closed.
