ORDER

The petitioner's Bank account has been frozen on the directions of the first respondent and therefore, the petitioner has filed this petition seeking a direction to de-freeze his account. 2.The learned Government Advocate(Crl.side) appearing for the first respondent submits that a complaint was lodged by RR Steel Fabricators & Traders in Thirunagar before the respondent Police that one Shanmugavadivu offered TMT bar at lowest price in the market and they also insisted to pay advance amount of Rs.5,30,000/-. The defacto complainant has also paid a sum of Rs.6,93,639/- to Vital Corporation's account. A sum of Rs.30,000/- and Rs.5,00,000/- has also been paid on 11.09.2024 and 12.09.2024, respectively. Thereafter, there was no response from them. Further, he submits that the based on the complaint lodged by the defacto complainant, a case in Cr.No.82 of 2025 has been 2/5

registered for the offences under Sections 318(4) BNS and Section 66(D) of the Information Technology Act. Based on the available materials, they have made a request to attach the account of Vital Corporation. Since there was a transaction of Rs.20,000/- from the account of Vital Corporation to the petitioner, they have frozen the account of the petitioner.

3.Even according to the respondent Police, there was a transaction of Rs.20,000/- from the Vital Corporation. However, the entire Bank account of the petitioner has been frozen by the second respondent/Bank, on the instructions of the first respondent. Therefore, this court directs the second respondent/Bank to freeze the petitioner's account for the amount only to the extent of Rs.20,000/- and allow the petitioner to operate his account in respect of remaining amount. Accordingly, this criminal original petition is disposed of.
