ORDER

The petitioner, a permit holder under the provisions of the Motor Vehicles Act, 1988, failed to renew the permit for the period commencing from 16.11.2020.

2. It is the case of the petitioner that, due to the lockdown imposed during the COVID-19 pandemic, he was unable to revive his business and therefore, did not operate the bus. It is submitted that the petitioner has now attempted to revive his business and accordingly, filed an application for renewal of the permit along with payment of the requisite fee for the delay, in terms of Rule 193-A of the Tamil Nadu Motor Vehicles Rules, 1989.

3. It is further submitted that the second respondent has, however, refused to receive the said application, which is required for the first respondent to consider and pass appropriate orders for renewing the permit beyond the stipulated period.

4. The learned Government Advocate appearing for the respondents submits that the petitioner's application will be received, subject to the petitioner complying with the other statutory requirements.

5. Recording the above submission, this Writ Petition is disposed of with a direction to the second respondent to receive the petitioner's application, as and when the petitioner tenders the necessary charges and forward the same to the first respondent forthwith. The first respondent shall thereafter pass appropriate orders on merits and in accordance with law, as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order. No costs.
