PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 - 3 to convene the Council of Elumalai Town Panchayat for the purpose of moving no-confidence motion against the fourth respondent on the basis of the notice given by the petitioner and majority of the members dated 28.06.2023 and 20.07.2023. The present writ petition has been filed by the Councilor of the 2nd ward in the third respondent Town Panchayat seeking direction as against the first respondent to initiate appropriate proceedings as against the fourth respondent by convening a meeting for initiating no confidence motion as against the fourth respondent.

2. Though the representations were made as early as on 28.06.2023 and 28.07.2023, so far no steps have been initiated by the first respondent. Hence, the present writ petition. 2/4

Without going into the merits of the allegations made in the writ petition, the first respondent is directed to consider the request of the petitioner and pass orders after giving due opportunity to the writ petitioner and the fourth respondent. This exercise shall be completed within eight (8) weeks from the date of receipt of a copy of this order.
